Terms of Service

Booking & Cancellation Policy

How to book

To initiate the booking process, please send an email to hello@charlie-harris.com or submit an inquiry form on our website. After your initial contact, we may request further details to understand your needs better. This could involve filling out a questionnaire or having a discussion via Zoom, email, or in person. Based on our conversation and your requirements, we'll provide a detailed quotation and contract. This will include a comprehensive breakdown of all charges, our mutual agreement, and a brief.

Deposit requirements

To confirm your booking, you may need to sign a contract and pay a non-refundable 50% deposit via credit or debit card. This deposit secures your spot and allows us to start planning for your shoot.

Cancellation terms and applicable fees

If for any reason you need to cancel your booking, please inform us as soon as possible. The specifics of our cancellation policy will be detailed in your contract but please note the deposit is non-refundable. In the event of a cancellation, certain fees may be retained to cover the costs incurred in preparation for your project. These will be clearly outlined in your contract.

---

Fees and Payment Terms

We accept payments through credit or debit cards via Stripe, a trusted and secure online payment platform. All prices quoted for our services are inclusive of all taxes and VAT. The amount you see in your contract is the total amount with no hidden fees.

---

Client Obligations

Communication

Your prompt responses to inquiries or requests are essential. Timely communication enables us to effectively prepare and customize your project to meet your specific needs. Payments must be made by the deadline outlined in the quotations and agreements.

For Product Photography

Please ensure that your products are shipped to us well in advance of the scheduled shoot, accounting for possible postal delays, especially for overseas shipping. Products must be securely packaged and should represent the highest quality version of the item for optimal photographic results.

For Property Photography

The property should be clean, tidy, and styled as you would present it to a guest. While minor styling and adjustments might be made to capture certain shots, the property should be as close to guest-ready as possible. Ensure that all aspects of the property, including lighting and appliances, are fully functional. A release form must be signed by the property owner, which will be provided alongside the contract prior to the shoot authorising the photography session. This form is crucial for ensuring that all legal bases are covered and that the shoot proceeds smoothly.

Your adherence to these obligations is vital in ensuring a successful, efficient, and legally compliant project. Your cooperation is greatly appreciated and contributes significantly to the quality of the final deliverables.

For Digital Marketing & Strategy Services

For projects involving SEO, social media, email marketing, paid ads, or content creation, you must provide timely access to relevant accounts, assets, and brand guidelines as needed. Delays in providing necessary materials or approvals may result in extended timelines.

For Website & Funnel Optimisation

If website or funnel optimisation services are provided, you are responsible for ensuring that any third-party software, hosting, or integrations required are in place and accessible. We will communicate any technical requirements in advance to facilitate a smooth workflow.

Your adherence to these obligations ensures efficient collaboration, high-quality results, and a smooth project experience. Your cooperation is greatly appreciated and contributes significantly to the success of your project.

Delivery of Services

Photography Services

After the photo session, as scheduled in the contract, we will professionally edit your images. A watermarked preview of all images will be provided within 7-10 working days. Upon receipt of final payment, you will receive two versions of each image—a high-resolution version for print and design and a low-resolution version for web and social mediawithin 2-3 working days.

Digital Marketing Services

Delivery timelines for SEO, content creation, social media management, email marketing, PPC, and strategy services will be outlined in your contract or service agreement. Most deliverables, such as audits, reports, or campaign assets, will be provided within the agreed project timeline. Any delays in receiving required client materials (e.g., branding assets, account access) may extend delivery times.

---

Intellectual Property Rights

Photography & Visual Content

The copyright of all images remains with the Photographer. Clients receive a license to use images for business, promotional, or personal use as outlined in the contract. Images cannot be claimed as your own or resold without explicit permission. The Photographer retains the right to use images for portfolio, marketing, and business promotion, unless otherwise agreed in writing.

Digital Content & Marketing Materials

All written, graphic, and marketing content created as part of SEO, social media, email marketing, or campaign materials is licensed for use as agreed in the contract. You may not resell, redistribute, or modify these materials for third-party use without explicit permission.

---

AI-generated content

For photography and design work, AI-generated enhancements may be used to optimise final visuals (e.g., adding seasonal elements, latte art, or environmental adjustments). For marketing content, AI-assisted tools may be used for research, copy refinement, and automation. All AI-generated elements are ethically sourced and properly licensed.

---

Indemnification

You, the client, agree to indemnify and hold the Business, along with any of our employees, associates, or affiliates, harmless from any claims, losses, damages, or legal costs that may arise in connection with your use of our services. This means if a third party makes a claim against the Business because of the services we have provided to you, you will be responsible for covering any resulting expenses, including legal fees. This indemnification obligation is designed to ensure that the Business remains protected from any legal liabilities or claims related to your use of our services, ensuring that we are not held responsible for issues that may arise from our professional engagement with you.

---

Limitation of Liability

In providing our services, we always aim for the highest level of satisfaction. However, it's important to understand that our liability is limited. This means that the Business will not be held responsible for any indirect, incidental, or consequential damages that may arise from the use of our services. This includes any losses or damages you might incur due to delays, non-delivery, or unexpected circumstances affecting the final outcome of our services. Essentially, while we are committed to delivering quality service, we cannot be held liable beyond the direct services we provide.

---

Confidentiality

We take your privacy and the confidentiality of your information seriously. Every piece of personal information, project detail, or business data you share with us during our professional engagement is handled with the highest level of confidentiality. We assure you that your information will not be disclosed, shared, or misused by us under any circumstances. In addition to our commitment to confidentiality, we take significant measures to maintain and protect our website and the third-party systems we use. However, it's important to understand that while we strive for the highest security standards, we cannot be held liable for any breaches of data that occur due to the actions or failures of third-party applications and integrations.

---

Dispute Resolution

In the event of any dissatisfaction with our services, we request that you first contact us via email to express your concerns. We are committed to addressing and rectifying any potential breaches of our agreement promptly and efficiently. Our primary goal is to find a satisfactory resolution that aligns with the terms of our contract. Should the issue not be resolved through direct communication and attempts at rectification, we encourage resolving the dispute through mediation rather than resorting to legal action. Mediation involves a neutral third party who will help facilitate a mutually agreeable solution. We believe this method not only saves time and resources but also preserves the professional relationship by fostering constructive and respectful dialogue. Only if mediation does not result in a resolution will we consider other legal remedies.

---

Governing Law and Jurisdiction

These Terms of Service & Website and any disputes or claims arising out of or in connection with them, their subject matter, or their formation (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of the United Kingdom. Specifically, any legal matters or disputes will fall under the jurisdiction of the courts of England and Wales. This means that any legal proceedings or actions related to our services or these terms will be conducted according to the laws of England and Wales, and their courts will have the exclusive authority to resolve any such legal matters.

---

Amendment to Terms

Please note that these Terms of Service may be updated or amended from time to time to reflect changes in our practices, feedback from clients, or changes in the law. We encourage you to review these terms regularly to stay informed about how we are protecting your rights and interests. Any amendments will take effect immediately upon being posted on our website. Your continued use of our services after any such amendments constitutes your acceptance of the new terms. If you do not agree to the updated terms, you should discontinue using our services.
